Abstract

This paper discusses some psychological and legal considerations arising from the state of partial or total, temporary or permanent, incapacity that appears in the elderly patient suffering from mental disability in general or dementia in particular. A comparison is made between the legal options in the State of California and those in Israel. There are no definite or absolute tests of competence; professional people often have to walk a tightrope to avoid jeopardizing the patient's interests.
